As we celebrate the thirty-fourth anniversary of the signing of the Americans With Disabilities Act (ADA), a landmark piece of legislation that has significantly improved the lives of individuals with disabilities, New York State is preparing to take a sledgehammer to a program that has similarly benefited these individuals.

Consumer Directed Personal Assistance (CDPA), a program created by and for disabled New Yorkers to enable living in the community rather than in nursing homes, is at serious risk. New York State, under Governor Hochul’s direction, is in the process of awarding a 5-year contract worth $40 billion to one out-of-state company to take over as New York’s Statewide Fiscal Intermediary. This contract will not be subject to review by the Comptroller, who deemed it problematic in their post-budget report.

This means that every single fiscal intermediary, including yours, will be shut down and replaced by the Statewide Fiscal Intermediary.

The State plans to start on October 1, 2024 – which means only six months to transition 250,000 consumers and enroll all of our personal assistants into the new monopoly system. This will destroy our relationships with our current fiscal intermediaries and disrupt the entire system. Consumers will lose workers and end up in hospitals and nursing homes. We expect the new Statewide Fiscal Intermediary to lower workers’ pay, cut worker benefits and paid time off (PTO), and eliminate overtime.
